Shops To Operate 24/7: Maharashtra Govt Clarifies 

The Maharashtra government has officially clarified that all shops and commercial establishments in the state are now allowed to operate 24 hours a day, seven days a week. 

The government explicitly excluded bars, liquor stores, and other alcohol-serving outlets such as permit rooms, beer bars, wine shops, hookah parlors, dance bars, discotheques, and similar establishments from this 24x7 operational relaxation. These alcohol-related businesses must continue to adhere to the existing time restrictions as per the state's December 2017 notification. 

  • Permit rooms, beer bars, dance bars, hookah parlors, discotheques, and similar establishments where liquor is served must operate between 11:30 am and 1:30 am in Municipal Corporation areas, and between 11:00 am and 12:30 am in Municipal Council and other areas.
  • Wine and liquor shops must operate from 11:30 am to 11:30 pm in Municipal Corporation areas, 11:00 am to 11:00 pm in Municipal Council areas, and 11:00 am to 10:30 pm in other areas.

Balance Between Business Hours And Employee Welfare

This new directive comes after several complaints from business owners and trade associations that local police and authorities were imposing unnecessary restrictions on the operating hours of shops and service businesses. 

The decision is backed by the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. According to Section 16(1)(b) of this Act, establishments can remain open every day of the week provided that each employee is granted one continuous rest period of 24 hours per week. 

This Act defines a “day” as 24 hours beginning from midnight, legally supporting the shops' and other businesses' ability to function around the clock. This ensures a balance between extended business hours and employee welfare, mandating weekly offs without interruption, even in establishments that choose to operate 24/7.

Previously, theaters and cinema halls were also subject to restricted operating hours; however, they have now been exempted and are free to operate 24/7.

Economically, this move is expected to provide a significant boost to Maharashtra’s commercial activity. Urban centers such as Mumbai, Pune, and Nagpur are likely to see increased late-night shopping, dining, and service opportunities.
